If you have been looking at property in southern Spain, you will have seen the term “off-plan”. It simply means a home that is sold before it is finished, often before building work has even started. You buy from architectural plans, a specification document and computer-generated images, and you pay in stages while the home is built.
I have worked in real estate for over 15 years and now lead my own company, The Property Agent. Off-plan is a large part of what I do, so this is the plain-language explanation I give clients at the start. It answers what off-plan means, how it differs from other new homes, how the process works and what to look out for. Each point links to a longer guide when you want more.
Off-plan, new build, resale: what is the difference?
These terms get mixed up, so here they are side by side:
- Off-plan: you buy before or during construction and the home does not exist yet, or is only partly built.
- New build, completed: the home is finished and has never been lived in. You can see it before you buy.
- Resale: the home has had a previous owner. Different taxes apply, and I compare it with new build in new build versus resale in Spain.
In everyday use, people often say “off-plan” for any new development, even one that is nearly finished. The legal protections I describe below apply while the home is still being built.
Why people buy off-plan
The attractions are real, but I prefer to describe them carefully.
Choice and price
Early buyers get the widest choice of units, orientations and floors, and launch prices are often lower than those of the final phase. Payments are spread over the build, so you do not need the full price on day one.
Personalisation
Depending on the developer and the stage of construction, you may be able to choose floor and kitchen finishes, change a partition or upgrade fixtures. This is not always possible, so ask what is included before you reserve.
A modern, efficient home
A new home meets current building and energy standards, so you get modern insulation, efficient air conditioning and low maintenance in the first years.
Possible appreciation, with no guarantee
Homes in high-demand locations can rise in value during construction, but it is not guaranteed and markets can also fall. I look at the evidence in off-plan appreciation on the Costa del Sol.
The risks to understand
Knowledge and good advice can reduce most of them, but not all.
- Delays. Licences, labour and materials can push the delivery date. Check the delay clause and your right to terminate.
- The developer. You are relying on a company to deliver. I explain how to check one in developer reputation before buying.
- The market. Prices can move between reservation and completion.
- The finished home. Renders and show flats never match reality exactly, so ask what is included and verify views and surrounding plots.
How buying off-plan works, step by step
- Choose a development and unit. Narrow down area, budget and use. For where to look, see new developments on the Costa del Sol.
- Reserve. You pay a reservation to take the unit off the market while your lawyer reviews the documents.
- Legal review. Your own independent lawyer checks the building licence, the contract, the payment schedule and the bank guarantee. See how to choose a Spanish lawyer.
- Sign the private contract. You pay the first deposit, which varies by project.
- Pay in stages. Further instalments follow the schedule in the contract, usually over the length of the build. If you need a mortgage, read how to finance a new build home in Spain.
- Inspect before completion. Check the finished home against the specification. See how to inspect new builds before completion.
- Complete at the notary. You pay the balance, sign the deed and receive the keys.

How your money is protected
Spain has protections for buyers who pay before the home is finished. A developer who takes advance payments must guarantee them with a bank guarantee or insurance, and must hold them in a special account separate from its own funds. The building licence must exist before the guarantee obligation starts, which is why I never advise paying more than a small reservation before then.
The details, including how to check that your money is covered, are in how your deposit is protected when you buy off-plan. If you want the ten questions I ask before any reservation, read 10 essential questions to ask when buying off-plan.
Choosing the right developer and adviser
In a developer, look for completed projects you can visit, transparent payment terms, clear legal documentation and owners who will tell you how delivery went. In an adviser, look for someone who works for you, tells you when a project is not right and puts you in touch with an independent lawyer rather than the developer’s.
I help with the search, the comparison of developments and the introductions to lawyers, mortgage brokers and furnishing services. I do not give legal advice, which is your lawyer’s role.
Where off-plan is on offer on the Costa del Sol
The Costa del Sol has new developments from Sotogrande to Estepona, and each area suits a different buyer. Sotogrande is the choice for privacy, golf and international schooling, Benahavís for hillside views and gated golf communities, Estepona for beachfront living with services close by, and Casares, Manilva and La Alcaidesa for space and value. My area-by-area overview is in new developments on the Costa del Sol.
Practical tips before you reserve
- Appoint your own independent lawyer first.
- Ask for the guarantee in writing before the first payment, and pay only into the project account named in the contract.
- Read the specification as carefully as the floor plan.
- Budget for taxes and fees, not only the price. I cover them in the taxes that apply when buying property in Spain.
- Keep funds ready for each stage, and think ahead to whether you will live in, rent or sell the home.
