La respuesta corta es que s\u00ed. A diferencia de las viviendas de segunda mano, que pagan el Impuesto de Transmisiones Patrimoniales (ITP), las viviendas de obra nueva vendidas por un promotor pagan IVA. La obra nueva no est\u00e1 exenta de IVA, y darlo por hecho es uno de los errores de presupuesto m\u00e1s comunes que veo en compradores internacionales.<\/p>\n<h2>\u00bfCu\u00e1nto IVA se paga en una vivienda de obra nueva?<\/h2>\n<p>El tipo de IVA est\u00e1ndar en una vivienda nueva es del 10%, cuando la vende por primera vez el promotor. En un apartamento de 300.000 \u20ac en Marbella, son 30.000 \u20ac de IVA que se suman al precio. Comprueba siempre si el precio que te dan incluye o no el IVA, porque los folletos no son coherentes. P\u00eddelo por escrito.<\/p>\n<p>En una compra sobre plano, el IVA se suele cobrar en cada plazo que pagas durante la construcci\u00f3n, no solo en la firma. El promotor debe emitir una factura por cada pago, y los importes deben reflejarse en el contrato. Explico c\u00f3mo se protegen esos pagos en <a href=\"https:\/\/thepropertyagent.es\/es\/los-beneficios-de-comprar-una-vivienda-sobre-plano\/\">c\u00f3mo se protege tu dep\u00f3sito al comprar sobre plano<\/a>.<\/p>\n<h2>El IVA no es el \u00fanico impuesto: el AJD<\/h2>\n<p>Adem\u00e1s del IVA, el comprador de obra nueva paga el Impuesto de Actos Jur\u00eddicos Documentados (AJD) al firmar la escritura. El tipo lo fija cada comunidad aut\u00f3noma. En Andaluc\u00eda el tipo est\u00e1ndar es actualmente del 1,2%, de modo que IVA y AJD suman alrededor del 11,2%. Repaso el c\u00e1lculo en <a href=\"https:\/\/thepropertyagent.es\/es\/ajd-en-andalucia-cuando-se-paga-al-comprar-vivienda-y-como-calcularlo\/\">AJD en Andaluc\u00eda<\/a>.<\/p>\n<p>Los gastos de notar\u00eda, registro y abogado son aparte de los impuestos y hay que sumarlos al presupuesto. Las viviendas nuevas compradas al promotor pagan IVA. Las viviendas de segunda mano compradas a un particular pagan ITP. En Andaluc\u00eda el ITP es actualmente del 7%. Por tanto, en porcentaje la factura fiscal es m\u00e1s alta en la obra nueva, pero el precio, el estado, las garant\u00edas y los costes de mantenimiento son distintos, as\u00ed que compara el coste total. Mi comparaci\u00f3n est\u00e1 en <a href=\"https:\/\/thepropertyagent.es\/es\/obra-nueva-reventa-espana\/\">obra nueva o reventa en Espa\u00f1a<\/a>.<\/p>\n<h2>Casos en que el tipo es distinto<\/h2>\n<ul>\n<li><strong>Vivienda protegida:<\/strong> algunas viviendas subvencionadas pueden tener un tipo reducido del 4%. Es raro en el mercado de la Costa del Sol y depende de calificaciones legales concretas.<\/li>\n<li><strong>Garajes y trasteros:<\/strong> las plazas de aparcamiento y los trasteros vendidos con la vivienda se tratan normalmente como la vivienda. Los que se venden por separado pueden tributar al 21%. Pregunta c\u00f3mo se aplica el impuesto en tu contrato.<\/li>\n<li><strong>Inmuebles comerciales:<\/strong> oficinas, locales y otros inmuebles no residenciales pagan el 21% de IVA.<\/li>\n<li><strong>Terrenos:<\/strong> un solar puede tener un tratamiento distinto seg\u00fan sea edificable y qui\u00e9n lo venda.<\/li>\n<\/ul>\n<h2>\u00bfPuedo recuperar el IVA?<\/h2>\n<p>No lo des por hecho. Recuperar el IVA depende de que el comprador sea una empresa que use el inmueble para una actividad que lo permita, y las reglas son estrictas. El alquiler de una vivienda para uso residencial no suele permitirlo. Si piensas comprar a trav\u00e9s de una sociedad, pide consejo a un asesor fiscal espa\u00f1ol antes de firmar, no despu\u00e9s.<\/p>\n<h2>Lo que digo a los compradores<\/h2>\n<p>Conoc\u00ed una vez a un comprador brit\u00e1nico que pensaba que comprar sobre plano significaba evitar los impuestos por completo. Lo detectamos en la primera conversaci\u00f3n, y le di un desglose completo de IVA, AJD y gastos legales para que pudiera fijar el presupuesto adecuado.
